PUTRAJAYA, Oct 28 – The Last Appeal Opposition Leader Datuk Seri Anwar Ibrahim to waive the five-year prison sentence for the offense of sodomizing a former aide, Mohd Saiful Bukhari Azlan, began in the Federal Court, here, today. Here is a recent development in a hearing before a panel of five judges led by Chief Justice Tun Arifin Zakaria.

Anwar’s counsel, Datuk Seri Gopal Sri Ram submit that the High Court judge erred in his ruling that the prosecution had established a prima facie case based on the evidence. He said that the judge erred in assessing the evidence of Mohd Saiful based on three aspects;

– In deciding Mohd Saiful competent witnesses.

– In deciding whether the evidence supported Mohd Saiful other witnesses.

– Refusing to allow the defense to examine the evidence of Mohd Saiful had given to the investigating officer who allegedly contradictory.
