KUALA LUMPUR, March 30 – The Magistrate Court here Tuesday set April 15 to decide on the application filed by activists Adam Adli Abd Halim and Mohd Fariz Abd Talib to refer the constitutional issue of their street demonstration charge to the High Court.
Magistrate Mohd Rehan Mohd Aris set the date after listening to submissions by counsel Eric Paulsen, who represented the duo, and deputy public prosecutor Raja Zaizul Faridah Raja Zaharudin, who appeared for the prosecution, regarding the application. Both activists had filed an application to challenge the constitutionality of their charge under the Peaceful Assembly Act 2012 for involvement in street demonstration last year.
On Sept 8, 2015, Adam Adli, 26, and Mohd Fariz, 45, pleaded not guilty to the charge of participating in the street demonstration that kicked off from the Sogo Complex on Jalan Tuanku Abdul Rahman to KLCC esplanade on February 28. The charge under Section 4(2)(c) of PAA provides a fine not exceeding RM10,000 upon conviction.
