GEORGE TOWN, April 29 – The Sessions Court today acquitted and discharged Seri Delima state assemblyman R.S.N. Rayer of using seditious words in a speech at Jalan Delima, Island Glades, Jelutong here two years ago. Judge Roslan Hamid made the decision after the prosecution failed to establish a prima facie case against Rayer at the end of the prosecution’s case.
Roslan, in passing judgement, said the words used by the accused did not show a seditious tendency. He said that the court hereby rules that the prosecution has failed to establish a prima facie case under Section 4(1)(b) of the Sedition Act 1948. The judge also acquitted and discharged Rayer, a lawyer, of an alternative charge under Section 504 of the Penal Code because the prosecution failed to prove the seditious elements made by the accused.
On August 27, 2014, Rayer pleaded not guilty to a charge of uttering seditious words during a speech at a playground in Jalan Delima, Island Glades, Jelutong at 10pm on May 22, 2014. He was charged under Section 4(1)(b) of the Act and punishable under Section 4(1) of the same Act, if found guilty.
In the meanwhile, Rayer was also charged on the alternative charge for intentional insult with intent to provoke a breach of the peace among UMNO members at the same place and time. Deputy Public Prosecutor Lim Cheah Yit appeared for the prosecution.
