GEORGE TOWN, Feb 26 – The magistrate’s court here today transferred the case involving fourteen boys charged with murdering bully victim, T. Nhaveen, in June last year to the High Court. Magistrate Mohamad Amin Shahul Hamid made the order following an application by the prosecution, conducted by deputy public prosecutor Nurul Fatin Hussin.
Present at today’s proceeding were Nhaveen’s mother and family members of the four accused. The four teenagers, including Form Four and Form Five students, were charged on June 19 last year with murdering Nhaveen. J.Ragesuthen and S.Gokulan, both 18 then, and two others, who are minors, were charged with committing the act together between 11 pm and midnight near the Karpal Singh Learning Centre, Jalan Kaki Bukit, Gelugor near here, on June 9, 2017.
The charge, under Section 302 of the Penal Code, provides the mandatory death sentence upon conviction. Meanwhile, in the Sessions Court, judge Irwan Suainbon fixed March 27 for mention of the case involving the four teenagers on a charge of causing hurt on T. Preevin,19, who is a friend of Nhaveen. Irwan set the date after deputy public prosecutor Farah Aimy Zainul, who prosecuted, informed the court that the prosecution had yet to receive some of the case documents.
The four accused, who are being held at the Sungai Petani Juvenile Prison, were charged with voluntarily causing grievous hurt on Preevin at the same place, time and date. The charge, under Section 326 of the Penal Code, read together with Section 34 of the same Act, provides an imprisonment for up to 20 years, and fine or whipping, if found guilty.
Nhaveen, 18, was seriously injured after being beaten by a group of teenagers at Jalan Kaki Bukit, near here, resulting in brain death. His friend, Preevin was also reported to be beaten up by the group using a helmet, but he managed to escape to seek help. Lawyer Datuk Ranjit Singh Dhillon, represented J.Ragesuthen and S.Gokulan, while the two juveniles were represented by lawyer S.Yagoo. — Bernama
